Terms & Conditions

1. Acceptance

By creating an account or using poléo you accept these Terms & Conditions and our Privacy Notice. If you do not agree, do not use the service.

2. What poléo is and who provides it

poléo is a point-of-sale, inventory, and management system for businesses («the Service»), operated by Miguel Zúñiga Rodríguez. The Service is provided «as is», with the features available at any given time. poléo has a cloud version (multi-store) and a desktop version for a single store (see section 11).

3. Your account

  • You must provide accurate information when registering.
  • You are responsible for your password, keeping it secret, and all activity in your account —including who you give access to and what permissions you grant.
  • Each owner registers their business and manages its users and permissions.
  • Let us know promptly if you believe someone is using your account without authorization.

4. Free trial

We offer a 10-day trial with no card required. When it ends, if you don't activate a paid plan, your account switches to read-only mode (you can view and export your information, but not record new operations) until you activate a plan.

5. Plans, prices, and payments

  • Plans and prices are shown in the Service. Prices are in Mexican pesos (MXN) plus the applicable VAT.
  • The subscription is charged in advance, automatically and recurringly, according to the cycle you choose (monthly or yearly), through Stripe. By activating a plan you authorize recurring charges until you cancel.
  • Prices may change. If the price of your plan changes, we will notify you in advance and the new price will apply from your next renewal.
  • If you change plans, the adjustment (charge or credit) is prorated based on the time remaining in your cycle.

6. What happens if a payment doesn't go through

We don't cut you off abruptly. If a charge fails:

  • Grace period: you keep working normally while we retry the charge and notify you.
  • Read-only: if it isn't resolved, your account switches to read-only —we never lose or delete your information; you can view and export it, only not record new operations.
  • Retention: we keep everything for 30 days in case you catch up and reactivate. As soon as you pay, your account returns to normal automatically.

7. Cancellation and refunds

  • You may cancel your subscription at any time. You will keep access until the end of the period already paid.
  • Payments already made are non-refundable, unless applicable law provides otherwise or we expressly agree.

8. Your data is yours

  • The information you capture in poléo is yours. We do not sell it or use it for purposes other than providing the Service (see Privacy Notice).
  • We store and back it up for you.
  • When you leave, you can export your information. If your account is canceled or suspended, we keep it for 30 days in case you wish to reactivate; afterward it may be permanently deleted, except what the law requires us to keep.

9. Acceptable use

You agree not to use poléo for illegal purposes, not to attempt to breach its security, overload it, or access other businesses' data. Violations may lead to suspension of your account.

10. Service availability

  • poléo relies on third-party infrastructure providers (cloud and hosting services) to operate. Because of this, the Service may have temporary interruptions, whether for maintenance or due to failures of those providers.
  • We commit to reasonable efforts to keep the Service available and restore it promptly when something fails, but we do not guarantee uninterrupted or error-free availability.
  • We are not liable for indirect damages or lost profits arising from temporary interruptions of the Service.
  • This is a common standard in software as a service: no serious provider promises 100% availability.

11. Desktop version (single store)

  • The downloadable version runs on your computer and keeps operating even without internet.
  • Cloud backup requires a periodic connection: while you're offline, your sales are saved locally and backed up the next time there's internet. It is your responsibility to connect regularly to keep your backup up to date.
  • In this version, product photos are not included in the cloud backup. The rest of your information (catalog, stock, sales) is backed up.

12. Invoicing (CFDI)

Invoice (CFDI) issuance is a feature you can enable that depends on your tax details and an authorized provider. You are responsible for the accuracy of the tax information you enter.

13. Limitation of liability

To the extent permitted by law, poléo will not be liable for indirect damages, data loss due to causes beyond our control, or lost profits. Our total liability is limited to the amount you have paid for the Service in the last 3 months. You are responsible for keeping backups of your business's critical information.

14. Intellectual property

The «poléo» brand, the software, and the site are owned by Miguel Zúñiga Rodríguez. You are granted no rights over them other than the use of the Service under these Terms.

15. Changes to the Terms

We may modify these Terms. We will publish the current version at poleo.app/en/terms; if the change is significant, we will notify you. Continued use of the Service constitutes acceptance of the changes.

16. Governing law and jurisdiction

These Terms are governed by the laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Mexico City, waiving any other jurisdiction.
